Terms and Conditions of Use for the Disability Claim Builder
These Terms and Conditions ("Terms") govern your use of the Disability Claim Builder platform ("Platform"), operated by Unbound Disability Claims ("Company"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
1. Access to the Platform:
- The Platform is provided for the purpose of assisting individuals in preparing and submitting Social Security Disability (SSD) claims.
- Access to the Platform is provided to eligible applicants referred by participating hospitals.
- The fees for accessing the Platform are paid by the referring hospital on behalf of the applicant.
2. Use of the Platform:
- You may use the Platform solely for the purpose of preparing and submitting your SSD claim.
- You agree not to use the Platform for any unlawful or prohibited purpose or in any manner that could damage, disable, overburden, or impair the Platform.
3. Account Registration:
- In order to access certain features of the Platform, you may be required to register for an account.
- You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Intellectual Property:
- All content and materials available on the Platform, including but not limited to text, graphics, logos, images, and software, are the property of Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.
- You may not modify, reproduce, distribute, transmit, display, perform, or create derivative works of any content or materials from the Platform without the express written permission of Company.
5. Privacy Policy:
- Your use of the Platform is subject to the Company's Privacy Policy, which is incorporated herein by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
6. Limitation of Liability:
- In no event shall Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
- Company's total liability to you for any claims arising out of or in connection with these Terms or your use of the Platform shall not exceed the amount paid by the referring hospital in connection with your use of the Platform.
7. Governing Law:
- These Terms shall be governed by and construed in accordance with the laws of Orange County, Florida, without regard to its conflict of law principles.
8. Modifications to Terms:
- Company reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
9. Termination:
- Company reserves the right to suspend or terminate your access to the Platform at any time for any reason, without prior notice or liability.
